CLIENT TERMS DEFINITIONS

'Client', 'you' means the individual, company or business engaging our Services.

'Service' or 'Services' means the provision and production of all types of photographic images, for personal, corporate and commercial business, marketing and other purposes as agreed.

'Quote' means the most recent fully inclusive cost quote or proposal for the Project provided to the Client.

'Project' means the Client work outlined in detail in the Quote.

'Content' means any and all material, links, words, moving and still images and anything else that forms part of any Project and our Services.

‘The Photographer’, we', 'our' and 'us' means Em Callaghan Photography.

IMAGE LICENSING AGREEMENT DEFINITIONS

In this Agreement the following definitions apply:

"Attribution" means all Licensed Material, including any modified form, must show the owner or creator and URL or hyperlink to our website or Instagram account.

"Commercial Use" means any use intended for or directed towards commercial advantage or monetary compensation, other than for your own personal website use.

"Licensed Material" means any still image, electronically, digitally or by any other means, including original digital files, prints, or any other product protected by copyright, trademark, patent or other intellectual property rights, which is licensed under the terms of this Agreement.

"Permitted Uses" means the Licensed Material can only be used for: advertising and promotion, merchandise and product packaging, websites and social media.

"Reproduce" means to make copies or publish the whole or any part of the Licensed Material, via any medium and by whatever means, including storage of in digital form or other electronic medium.

"Restrictions" means you may not use the Licensed Material in a way that may be considered, by a reasonable person, immoral, controversial or inappropriate.

"Terms of Business" means the terms governing purchase of goods and services via the website or custom photography services as relevant.
